    Below is the most current price list for new member purchases made directly through Disney Vacation Club. When purchasing direct from DVC, new buyers are required to purchase a minimum of 100 points for most of the resorts whereas existing owners can purchase as little as 25 points.

    NOTE: Disney Vacation Club has closed its waiting list for points at several resorts including the Beach Club and Grand Californian.  Purchasing points at these resorts direct from DVC is impossible unless individuals placed their name on the waiting list before its closure.

    Below you will find sales and ROFR data from offers that were accepted and sent to ROFR during the months of May and June. Disney’s Right of First Refusal (ROFR) takes approximately 30 days from the date sale contracts are submitted to DVC. We only saw one contract exercised under Disney’s Right of First Refusal in May and June with all other contracts waived.

    Sale prices remained steady for Animal Kingdom, Saratoga Springs and Grand Floridian compared to April resales. Aulani, Beach Club and Old Key West average prices decreased compared to the earlier months of the year but are still in-line with or higher than average sale prices from 2015. Bay Lake Tower’s average sale price increased mainly due to a large amount of small-point contracts that were sold in May and June. Small point contracts typically fetch a higher per point price than others.

Below you will find sales and ROFR data from offers that were accepted and sent to ROFR during the month of April. Average sale prices slightly decreased for most resorts in April compared to March resales with increases seen at Beach Club and Old Key West. Average sale prices remained steady in March compared to February resales with very slight decreases seen at Beach Club, Old Key West, Hilton Head and Vero Beach.     Part of every resale purchase is Disney’s Right of First Refusal (ROFR) which takes approximately 30 days from the date contracts are submitted to DVC. We strive to inform all buyers and sellers of current market conditions and because of that, we typically run a very low “buy-back” rate around 5%. This month we saw a slightly higher rate with 8% of total sales exercised (purchased by Disney) and 92% of sales approved.     Disney’s Right of First Refusal (ROFR) is in place to protect the value of ownership by not allowing their product to be sold below “fair market.” Although price is an important factor in Disney’s decision making, there are other factors that are not made public and we never know for sure why one contract is chosen over another. We strive to council all buyers and sellers on market conditions to ensure sellers get “fair market” and buyers get the ownership they want. Because of that, our company runs a very low ROFR “buy-back” rate. For 2015, Disney buy-backs accounted for 5.3% of our total sales. 

    Below you will find a chart of our sales that were purchased by Disney in 2015 under their Right of First Refusal (ROFR). First column is the resort, second is the contract size (amount of points), and the third column is the price per point that was agreed upon by buyer and seller. The majority of the contracts bought by Disney last year were at Old Key West.

  8. Changes to FIRPTA

    Non U.S. Sellers: On December 18, 2015, President Obama signed the Protecting Americans from Tax Hikes Act of 2015 into law. This new Act increases the FIRPTA withholding for Non-U.S. Citizens from 10% to 15%. This change is effective for closings occurring February 16, 2016 and after. You can file with the U.S. Government to receive a refund as the tax is due ultimately only on a profit. Please note that this tax is only for Non-U.S. citizens selling their ownership.

    What is FIRPTA?

    The disposition of a U.S. real property interest by a foreign person (the transferor) is subject to the Foreign Investment in Real Property Tax Act of 1980 (FIRPTA) income tax withholding. FIRPTA authorized the United States to tax foreign persons on dispositions of U.S. real property interests.

    A disposition means “disposition” for any purpose of the Internal Revenue Code. This includes but is not limited to a sale or exchange, liquidation, redemption, gift, transfers, etc. Persons purchasing U.S. real property interests (transferees) from foreign persons, certain purchasers’ agents, and settlement officers are required to withhold 15% (10% for dispositions before February 17, 2016) of the amount realized on the disposition (special rules for foreign corporations).

    A recent article posted in the Orlando Sentinel brought to light the foreclosure process that occurs each year for hundreds of Disney Vacation Club owners. Although DVC foreclosures are very low at less than 1% of total ownerships, its still a hard reality for some owners who cannot meet the financial requirements for their membership.

    Foreclosure Process

    The moment you miss the final deadline for payment, you will not be able to make new reservations, modify existing ones, or bank/borrow points. You are essentially “locked out” until your account is up to date.

    Within a few months of being in default, Disney will place a lien on your contract for unpaid mortgage payments, unpaid maintenance fees or both. This will come from Disney Vacation Club and/or Palm Financial Services, the company that services DVC loans. This can come quickly, within a few months of missing payments so it’s important to be aware and get back on track with monies owed as quickly as possible. There will be added late fees and penalties, possible attorney fees as well.

    If the lien is not paid, then they will move on to foreclosure proceedings and issue a Notice of Trustee’s Sale with a date for paying all owed funds as well as a date your property will be up for auction. If the amount due and fees are not paid by the date on the notice, your property goes to auction and that cannot be undone.

    What Can You Do

    If you are an owner struggling to make your mortgage payments or annual dues, please contact us about your options. Even if Disney has started the foreclosure process, there are still alternatives that you can pursue in order to avoid a foreclosure.

    Budgets for most of the Disney Vacation Club resorts have been released according to DVCnews.com. Aulani budgets have yet to be released. Average increase for all resorts is around 3% with Vero Beach seeing the lowest at 0.31% and Saratoga Springs seeing the largest increase at 5.11%. Your annual dues are applied to a variety of vital interests including: Operating Expenses (housekeeping, transportation (if applicable), front desk services, maintenance, utilities, etc), Administrative Expenses, Refurbishment Expenses and Real Estate Taxes.

    The 2016 budgets will be formally ratified at the 2016 annual meeting scheduled for Thursday, December 10, 2015.
